Who we are

SmartGenius is operated by OLHARY LTDA, a Brazilian company registered under CNPJ 60.758.275/0001-10, at Rua Ilicínia 222, Horto Florestal, São Paulo/SP 02378-070, Brazil ("we"). By creating an account you accept these terms and our Privacy policy.

If you use the service on behalf of a company, you confirm you have the authority to accept them on its behalf.

What the service does

SmartGenius is your brand's social media manager: from an idea, a link or photos, or from the Autopilot schedule you set, it generates copy and images with artificial intelligence, builds posts and carousels true to your profile's brand (such as its colors, logo and tone of voice) and publishes to the connected Instagram account with your approval or, if you set Autopilot that way, on its own, or hands you the files to download and post anywhere.

Features that depend on third-party approval (scheduling, for instance, which is waiting on Meta's review) are flagged in SmartGenius until they are available.

Your account

You must be 18 or older and provide accurate information. Your password is your responsibility, as is everything that happens in your account and in the workspaces you administer.

Accounts are personal. Team members join by invitation, with the role you assign.

Instagram and Meta

The Instagram connection uses Meta's official API and is subject to Meta's terms and platform rules. We only publish to the account you connected, the way you set it up: with your approval or, when you set Autopilot that way, without waiting for it.

You can disconnect at any time; that profile's scheduled posts return to "approved" and nothing further is published. We do not accept personal accounts or unauthorized access methods.

The API and other agents

A workspace admin can create API keys so other programs, like an AI assistant, can use SmartGenius. Each key acts as the person who created it, with the same permissions: what it does counts as done by that person. Keep a key like a password, and revoke it when you no longer need it. Connecting an assistant through its own sign-in (like claude.ai or ChatGPT) makes a key the same way, in the name of whoever connected it.

Through the API you can draft posts and generate images, including images that have nothing to do with Instagram. Only a person approves and publishes, inside SmartGenius. Each image uses the same plan quota, and the acceptable-use rules apply the same way. Links to images made through the API work for 7 days; after that, the files are deleted.

Each key has a limit on calls per minute, listed in the API docs. We may revoke a key that breaks these terms.

Your content

Photos, copy, logos and trademarks you upload remain yours. You authorize us to process them solely to provide the service, and you confirm you have the right to use what you upload.

Content generated for you is yours to use as you wish, within the rules of the platforms you publish to.

Acceptable use

You may not use the service for content that is illegal, misleading or offensive, that infringes third-party rights or breaks Instagram's rules, or to try to get around limits, quotas or security systems.

We may suspend or close accounts that break this rule, notifying you whenever possible.

Plans, payments and cancellation

The free plan has monthly limits. Paid plans are billed monthly in the currency shown before you pay (Brazilian reais, US dollars or euros) and renew automatically until you cancel; cancellation takes effect from the next billing cycle. A workspace's first purchase sets the currency for every purchase after it. Image packs are one-time purchases and never expire.

Online purchases can be canceled within 7 days under Brazil's Consumer Protection Code. Current prices are always published on the site and in SmartGenius.

Artificial intelligence

Copy and images are generated by third-party AI models and may contain errors or inaccuracies. Review before approving. If you set Autopilot so posts go out on their own, the content is still published in your name and under your responsibility. You can hold a post, change the Autopilot settings or pause everything at any time.

We do not guarantee reach, engagement or sales.

Availability and liability

We work to keep the service up, but it may go down for maintenance or because of failures, including at third parties: Meta, AI providers, payment processors.

To the extent the law allows, our liability for damages is limited to what you paid for the service in the 12 months before the event.

Termination

You can delete your account at any time in your settings; your data is erased as described in the Privacy policy. We may close accounts that violate these terms.

Changes

We may update these terms. Material changes are announced by email or in SmartGenius with reasonable notice; continuing to use the service after that means you accept the new version.

Governing law and venue

These terms are governed by Brazilian law. For consumers, the courts of your place of residence have jurisdiction; in all other cases, the courts of São Paulo/SP.
